Safety, licensing, and insurance
Roof work is high-risk work, and licensing and insurance requirements change at every state line. For a multi-site owner, that is a real exposure. This page explains how responsibility is divided on a TEMA IFM program and what our contractor agreement requires before work is assigned.
How responsibility is divided
TEMA IFM manages the program.
We assess roof conditions, develop scopes, select and manage contractors, review completed work against the contract documents, and report to you.
Network contractors perform the roofing work.
The contractor performing the work holds the license required in that jurisdiction, obtains the permits, and is responsible for the safety of its crews and its jobsite.
You have one point of contact.
We collect and track the qualification, licensing, and insurance documentation so your team does not have to manage it market by market.
Safety
Our own team
TEMA IFM staff access roofs to perform assessments and inspections. They work under a written safety and fall protection program and hold OSHA 10-hour or 30-hour construction safety training.
What our contractor agreement requires
Each contractor in our network is responsible for its own safety program. Under our Master Subcontract Agreement, contractors agree to:
- Comply with the Occupational Safety and Health Act of 1970, state-plan equivalents, and all applicable safety regulations.
- Furnish, inspect, and maintain personal protective equipment and fall protection for their crews, and take responsibility for the training and competency of their personnel, including any OSHA competent person designation.
- Disclose their Experience Modification Rate (EMR) for the current and two prior years, their Total Recordable Incident Rate (TRIR), their written safety and fall protection programs, and any OSHA or state-plan citations in the past three years.
- Report any injury, property damage incident, or near-miss to TEMA IFM within 24 hours, and report immediately any OSHA-reportable event, OSHA inspection, or citation related to the work.
- Provide a site-specific emergency contact list before work begins.
- Stop work and notify us immediately on encountering suspected asbestos, lead, mold, PCBs, or other hazardous material that was not identified in the scope.
Occupied facilities
Much of our work takes place at occupied buildings, including senior living communities and healthcare facilities. Contractors agree to:
- Follow your site access, badging, and background screening requirements, and not assign anyone who does not meet them.
- Maintain a substance-free worksite and comply with your substance testing program where one applies.
- Keep crews within the work area and follow posted site rules.
Stop-work authority
TEMA IFM and the client each have the right to stop work on observing a condition that presents an imminent danger.
Licensing
Contractor licensing rules vary by state and often by municipality. On a TEMA IFM program, roofing work is performed by a contractor licensed, registered, or certified as that jurisdiction requires. Under our Master Subcontract Agreement, contractors:
- Represent that they hold, and will maintain, every license, registration, and certification required for the work in each jurisdiction where they perform it.
- List each license by state, number, class, and expiration date, and authorize TEMA IFM to verify it with the issuing authority.
- Notify us promptly of any lapse, suspension, revocation, or disciplinary action, and within 10 days of any other material change to their qualifications.
- Obtain the permits and inspections the work requires, unless the work order assigns that responsibility elsewhere.
- Provide permits and final inspection sign-offs as part of project closeout, before final payment.
Failure to maintain required licensing or insurance is an event of default under the agreement.
Insurance
TEMA IFM coverage
TEMA IFM, LLC carries commercial general liability, business automobile liability, umbrella liability, and workers' compensation and employer's liability coverage. A current certificate of insurance is available on request.
What our contractor agreement requires
Before starting work, and at each policy renewal, contractors provide certificates of insurance with the required endorsements. Our minimum requirements:
| Coverage | Minimum limit required of contractors |
|---|---|
| Workers' compensation | Statutory, in every state where work is performed |
| Employer's liability | $1,000,000 each accident; $1,000,000 disease, each employee; $1,000,000 disease, policy limit |
| Commercial general liability | $1,000,000 each occurrence; $2,000,000 general aggregate, applied per project; $2,000,000 products and completed operations aggregate |
| Business automobile liability | $1,000,000 combined single limit, covering owned, hired, and non-owned vehicles |
| Umbrella or excess liability | $2,000,000 each occurrence and aggregate; $5,000,000 on capital projects over $250,000 |
| Contractor's pollution liability | $1,000,000 each occurrence; $2,000,000 aggregate, where the scope involves hazardous or regulated materials, hot asphalt, torch-applied systems, solvents, or coatings |
| Professional liability | $1,000,000 per claim; $2,000,000 aggregate, where the scope includes design or engineering |
In addition:
- Additional insured status. TEMA IFM, the client, and the property owner are named as additional insureds on the contractor's general liability, automobile, umbrella, and pollution policies, for both ongoing and completed operations.
- Primary and non-contributory. The contractor's coverage responds first.
- Waiver of subrogation in favor of TEMA IFM, the client, and the property owner.
- Insurer rating. Carriers must be rated A- / VIII or better by A.M. Best.
- No gaps for the work itself. General liability coverage may not carry a residential, roofing, height, or subcontractor exclusion that would exclude the work.
- Your requirements govern. Where your contract with us calls for higher limits or broader coverage, that requirement governs once it is written into the contractor's work order.
